Text of H.R. 3226 Czar Accountability and Reform Act of 2009 - Attempt to put a stop to a subversion of the Constitution by the Executive Branch.

This bill would require “that appropriated funds may not be used to pay for any salaries or expenses of any task force, council, or similar office which is established by or at the direction of the President and headed by an individual who has been inappropriately appointed to such position (on other than an interim basis), without the advice and consent of the Senate.”

The crux of it is that a President can no longer appoint “Czars” without the advice and consent of the Senate as provided for in Article II, Section 2 of the US Constitution.  If a President chooses to do so anyway, then federal monies cannot be used for their salaries or expenses.

This should have never been an option for Presidents regardless of party.  The Constitution is quite clear on this issue and any other mechanizations is clearly unconstitutional and should be dealt with appropriately.  The complacency of Congress in this issue of the past several decades has allowed this practice to get out of control as is seen today with the 26 or so (all radical leftists that do not represent the general beliefs and principles of the American people) Czars under the current administration.  The only good thing that has come from this is the showing of the true colors and ideological leanings of Obama and his cronies.

Republicans file the Czar Act of 2009 - it's time to tell Obama 'Hell no you can't'. - Great post on Examiner.com

http://www.examiner.com/x-9100-Boston-Conservative-Independent-Examiner~y2009m7d25-Republicans-file-the-Czar-Act-of-2009--its-time-to-tell-Obama-Hell-no-you-cant#

H.R. 3226 is a much needed piece of legislation to stop the rampant subversion of the Constitution by the Obama Administration.  Obviously this will go nowhere in the liberal, Obama minion Congressional environment that exists now.  With a little luck the elections of 2010 will provide a more conducive climate for this bill.  The appointing of Czars that are not vetted by the Senate or anyone else and answer only to the Executive Branch is a clear violation and subversion of the US Constitution.  Had this been Venezuela, China, N. Korea, Iran, or some other tyrannical, despotic regime then maybe it would be a different story.

Health bills might not protect needy Americans - More good news about the liberal's heathcare takeover plan

http://www.mcclatchydc.com/homepage/story/74912.html#

So much for taking care of those that the liberals are claiming to be looking out for in this government power grab called healthcare reform.  “Under the House Democrats' proposal, people receiving government subsidies could still end up spending 20 percent or more of their annual incomes on premiums, deductibles and co-insurance, according to estimates prepared by the House Committee on Ways and Means... That financial load could grow substantially if the proposal's financing — $1 trillion over a decade — is pared back as congressional leaders come under pressure to reduce the legislation's costs.”  I thought this was all supposed to be a free ride for Americans.  Isn’t that what the Democrats have been claiming?  If they are wrong about that, where else are they in error?  I would accuse the Democrats of lying, but that would take a knowledge of the subject matter to do so.

Liberals push Obama to make gov't-run health care - Was there ever any doubt it was about government control?

http://www.breitbart.com/article.php?id=D9AGPV8G1&show_article=1#

“House liberals pleaded with President Barack Obama on Friday to push for creation of a government-run health care program as the Senate's chief negotiator said he won't wait much longer for Republicans to compromise amid dwindling chances for a bipartisan bill.”  And liberals keep telling me that it is about reform not government control.  Yeah right.  At least now the liberals are being upfront about it rather than denying what their true intentions are.  Kudos to the Republicans for standing strong against this massive power grab.  Is there a need for healthcare reform?  Yes.  But this is not the answer.  The government has not been able to run a program cost effectively or efficiently up to this point, what makes people think that they can do it by taking over almost a fifth of the economy?  And what about the big lie that healthcare coverage will be free?  Nothing is free, someone has to pay for it.

Obama May Need Sense of Crisis to Revive Health-Care Overhaul - When will some of his policies get implemented because of their merits rather than from fear and panic?

Obama May Need Sense of Crisis to Revive Health-Care Overhaul
Share | Email | Print | A A A

By Julianna Goldman and Nicholas Johnston

Sept. 4 (Bloomberg) -- President Barack Obama returns to Washington next week in search of one thing that can revive his health-care overhaul: a sense of crisis.

Facing polls showing a drop in his approval, diminished support from independents, factions within his Democratic Party and a united Republican opposition, Obama must recapture the sense of urgency that led to passage of the economic rescue package in February, analysts said.

“At the moment, except for the people without insurance, we’re not in a health-care crisis,” said Stephen Wayne, a professor of government at Georgetown University in Washington. “You do need a crisis to generate movement in Congress and to help build a consensus.”

Obama speaks to labor leaders on Sept. 7 and to a joint session of Congress on Sept. 9 as he attempts to rebuild support for his top domestic priority, one that affects 17 percent of the economy. Lawmakers, trying to extend coverage to millions of uninsured Americans and rein in costs, are considering mandates on employers to provide coverage, new rules for insurers, and creating a government program to compete with private insurers such as Indianapolis-based WellPoint Inc.

Obama Chief of Staff Rahm Emanuel said the administration made unprecedented health-care progress in eight months.

‘Not There Yet’

“We gave Congress a charge, we gave them broad outlines, which is the reason we are farther along than any of the five presidents that have tried,” Emanuel said in an interview yesterday. “We’re not there yet, and this speech is intended to finish the job.”

Presidential speeches historically do little to move public opinion significantly, said George Edwards, author of “The Strategic President: Persuasion and Opportunity in Presidential Leadership.”

“This is almost like a Hail Mary, because they know that they’re substantially behind and the trajectory is negative for them,” Edwards said.

Unlike the financial crisis he inherited, the health-care debate is of Obama’s making and places a different burden on him, Edwards said.

“The best thing in presidential leadership is to recognize and exploit opportunities,” said Edwards. “The White House overestimated the nature of the opportunity.”

Stimulus Debate

Obama’s economic stimulus was debated as the Dow Jones Industrial Average dropped 18 percent from Nov. 4, 2008, to Feb. 13, when Congress approved the legislation. Unemployment had risen to more than 7 percent.

On the stimulus, Obama was able to say “that unless we do X right now, and X is pretty painful and pretty expensive, there is a serious danger in the next few weeks that the entire financial system will come crashing down,” said Bill Galston, a former official in President Bill Clinton’s administration, now a Brookings Institution scholar in Washington.

Emanuel remarked at the time that a crisis was a terrible thing to waste, and Obama pushed for health-care overhaul and energy legislation along with financial and auto bailouts.

He has framed health-care legislation as part of his long- term strategy to improve the economy. Republicans focused on the potential impact on patients. Throughout the summer and in town halls, Republican opponents said Obama wanted a government takeover of the system and creation of panels to decide end-of- life issues.

Democratic Critics

Within the Democratic Party, critics say Obama hasn’t pushed universal health care and others say the overhaul would balloon the federal deficit.

Obama “has said about this issue continually, if it was easy it would have been done by now,” said White House Communications Director Anita Dunn.

Obama’s difficulty on health care is compounded by broader economic worries. While 36 percent of Americans say the economy is getting better, only 10 percent see improvements in their households, according to a CBS poll at the end of August.

“People are not convinced the president’s strategy has helped their family during the economic downturn,” said Robert Blendon, a health-policy pollster at Harvard University in Cambridge, Massachusetts. “That has forced them to be more skeptical towards the president’s health-care proposals.”

Less than a fifth of Americans say a health-care overhaul will help them personally, compared to 31 percent who think the government’s efforts will hurt, and 46 percent who say it will have no effect, the CBS poll showed.

‘Not a Crisis’

“There is a problem in our health-care system today, and we need reform; it’s not a crisis,” said Ed Gillespie, White House counselor to President George W. Bush. “It’s just people saying this is way too much, way too fast, we don’t know where this money is going and we don’t know where it’s coming from.”

The CBS survey of 1,097 Americans Aug. 27-31 found Obama’s approval fell 12 percentage points from a high of 68 percent in April to 56 percent; the error margin is 3 percentage points.

A survey of 4,518 likely voters by Zogby International Aug. 28-31 put Obama’s approval rating at a record-low 42 percent; it also showed he’s well liked.

“He’s got to get control of his presidency,” said John Zogby, president of Zogby International. “There’s a way out of this. Some of it is going to have to be his personality and his ability to frame messages, which is still good.”

Rahm Emanuel has said in the past that a crisis should never be wasted. Apparently the only way Obama and his liberal allies can get anything done is during a crisis where the people are demanding that something, anything be done. Will it be the Swine Flu or something else that gives Obama his crisis. Heaven forbid that Obama's policies get passed on their merits rather than through fear and panic.

Van Jones compares Bush to a Crackhead. Imagine the uproar if the was a conservative talking about Obama.

This is more proof that Van Jones is a leftist radical and the hypocrisy of liberals and their media lap dogs. If this had been a conservative making these comments the howls of protest from the left and the media would have been deafening. When Van Jones says it, nothing but the sound of silence.

White House tight-lipped about Obama adviser - Yahoo! News

WASHINGTON – The White House is taking a mostly tight-lipped stance on an environmental adviser who made inflammatory statements in the past and is linked to efforts suggesting a governmental role in the 2001 terror attacks.

Van Jones, an administration official specializing in environmentally friendly "green jobs," issued a statement of apology on Thursday. When asked on Friday whether President Barack Obama still had confidence in him, White House press secretary Robert Gibbs said only that Jones "continues to work in the administration."

Gibbs then referred to Jones' own statement.

The matter surfaced after news reports of a derogatory comment Jones had made in the past about Republicans, and separately, of Jones' name appearing on a petition connected to the events surrounding the Sept. 11, 2001 terror attacks. That 2004 petition had asked for congressional hearings and other investigations into whether high-level government officers had allowed the Sept. 11 attacks to occur.

Jones flatly said in his statement that he did not agree with the petition's stand and that "it certainly does not reflect my views, now or ever."

As for his other comments he made before joining Obama's team, Jones said: "If I have offended anyone with statements I made in the past, I apologize."

They are circling the wagons folks. Further proof that the Obama administration agrees with this guys point of view. After all if there were any doubts, Van Jones would not have been appointed to the position he is currently in. I wonder how it would have been spun if Van Jones would have had to go through the Senate confirmation process that Obama's cabinet had to go through?

Van Jones: Only ‘Suburban White Kids’ Shoot Up Schools - Can this guy do anything but play the race card?

Man this guy is race obsessed!! How can I take him serious if everything is about race? Not all issues facing this country can be blamed on racial bias and hatred but Van Jones apparently can't see that. Everything that goes wrong has to be based on a racial bias according to this guy from what I see. Racial bias being the cause is one way to take personal responsibility out of the equation. Don't get me wrong there are times where race is an issue, but this guy takes it WAY too far.

Respected Leaders and Families Launch 9/11 Truth Statement Demanding Deeper Investigation into the Events of 9/11

NEW YORK CITY, NY (Oct. 26, 2004) - An alliance of 100 prominent Americans and 40 family members of those killed on 9/11 today announced the release of the 911 Truth Statement, a call for immediate inquiry into evidence that suggests high-level government officials may have deliberately allowed the September 11th attacks to occur. The Statement supports an August 31st Zogby poll that found nearly 50% of New Yorkers believe the government had foreknowledge and "consciously failed to act," with 66% wanting a new 9/11 investigation.

Focusing on twelve questions, the Statement highlights areas of incriminating evidence that were either inadequately explored or ignored by the Kean Commission, ranging from insider trading and hijacker funding to foreign government forewarnings and inactive defenses around the Pentagon. The Statement asks for four actions: an immediate investigation by New York Attorney General Eliot Spitzer, Congressional hearings, media analysis, and the formation of a truly independent citizens-based inquiry.

The Statement's list of signatories includes notables spanning the political spectrum, from Presidential candidates Ralph Nader, Michael Badnarik, and David Cobb to Catherine Austin Fitts, a member of the first Bush administration, as well as Washington veterans like Pentagon whistleblower Daniel Ellsberg and retired CIA analyst Ray McGovern. Other signers range from peace activists like Code Pink co-founder Jodie Evans and Global Exchange's Kevin Danaher to former US Ambassador and Chief of Mission to Iraq, Edward L. Peck; from environmentalists like Randy Hayes and John Robbins to business leaders such as Paul Hawken and Karl Schwarz, CEO of Patmos Nanotechnologies; from populist journalist Ronnie Dugger to renowned investigative reporter Kelly Patricia O'Meara.

The Statement also includes 43 noted authors, including New York Times #1 bestseller John Gray, as well as 18 eminent professors, historians, and theologians. Other notables include five-term Georgia Congresswoman Cynthia McKinney, singers Michelle Shocked and Michael Franti, and actors Ed Asner and Mimi Kennedy.

The Statement was facilitated by 911truth.org, a leading coalition. The organization has also announced a press conference outside of Eliot Spitzer's Manhattan office (corner of Cedar and Nassau) at 2:00PM on Thursday, Oct. 28th where 9/11 family members and victim group representatives will file a formal complaint demanding the first criminal investigation of 9/11 events by the New York Attorney General.

The Statement

We Want Real Answers About 9/11

On August 31, 2004, Zogby International, the official North American political polling agency for Reuters, released a poll that found nearly half (49.3%) of New York City residents and 41% of those in New York state believe US leaders had foreknowledge of impending 9/11 attacks and "consciously failed" to act. Of the New York City residents, 66% called for a new probe of unanswered questions by Congress or the New York Attorney General.

In connection with this news, we have assembled 100 notable Americans and 40 family members of those who died to sign this 9/11 Statement, which calls for immediate public attention to unanswered questions that suggest that people within the current administration may indeed have deliberately allowed 9/11 to happen, perhaps as a pretext for war.

We want truthful answers to questions such as:

  1. Why were standard operating procedures for dealing with hijacked airliners not followed that day?
  2. Why were the extensive missile batteries and air defenses reportedly deployed around the Pentagon not activated during the attack?
  3. Why did the Secret Service allow Bush to complete his elementary school visit, apparently unconcerned about his safety or that of the schoolchildren?
  4. Why hasn't a single person been fired, penalized, or reprimanded for the gross incompetence we witnessed that day?
  5. Why haven't authorities in the U.S. and abroad published the results of multiple investigations into trading that strongly suggested foreknowledge of specific details of the 9/11 attacks, resulting in tens of millions of dollars of traceable gains?
  6. Why has Sibel Edmonds, a former FBI translator who claims to have knowledge of advance warnings, been publicly silenced with a gag order requested by Attorney General Ashcroft and granted by a Bush-appointed judge?
  7. How could Flight 77, which reportedly hit the Pentagon, have flown back towards Washington D.C. for 40 minutes without being detected by the FAA's radar or the even superior radar possessed by the US military?
  8. How were the FBI and CIA able to release the names and photos of the alleged hijackers within hours, as well as to visit houses, restaurants, and flight schools they were known to frequent?
  9. What happened to the over 20 documented warnings given our government by 14 foreign intelligence agencies or heads of state?
  10. Why did the Bush administration cover up the fact that the head of the Pakistani intelligence agency was in Washington the week of 9/11 and reportedly had $100,000 wired to Mohamed Atta, considered the ringleader of the hijackers?
  11. Why did the 911 Commission fail to address most of the questions posed by the families of the victims, in addition to almost all of the questions posed here?
  12. Why was Philip Zelikow chosen to be the Executive Director of the ostensibly independent 911 Commission although he had co-authored a book with Condoleezza Rice?

Those who are demanding deeper inquiry now number in the hundreds of thousands, including a former member of the first Bush administration, a retired Air Force colonel, a European parliamentarian, families of the victims, highly respected authors, investigative journalists, peace and justice leaders, former Pentagon staff, and the National Green Party.

As Americans of conscience, we ask for four things:

  1. An immediate investigation by New York Attorney General Eliot Spitzer
  2. Immediate investigation in Congressional Hearings.
  3. Media attention to scrutinize and investigate the evidence.
  4. The formation of a truly independent citizens-based inquiry.

Given the importance of the coming election, we feel it is imperative that these questions be addressed publicly, honestly, and rigorously so that Americans may exercise their democratic rights with full awareness.

In closing, we pray and hope for the strength to approach this subject with wisdom and compassion so that we may heal from the wounds inflicted on that terrible day.

Van Jones is signer #46 and is in the prestigious company of Cynthia McKinney, Ed Asner, founders of Code Pink, and other left-wing fanatics. Accusing Bush of intentionally allowing the attacks to occur in order to go to war is taking conspiracy theory to a whole new level. What do these people think? That Republicans are lying awake at night trying to figure out how to start a war? And they call conservatives nuts.

Green jobs czar signed 'truther' statement in 2004 - This statement, signed by some of the most rabid liberals, demands an investigation into G.W. Bush's involvement in allowing the attacks to take place.

http://www.washingtontimes.com/weblogs/back-story/2009/sep/03/green-jobs-czar-signed-truther-statement-in-2004/#

This is one of the biggest “it’s all George Bush’s fault” things of all time.  This document demanded “an investigation into what the Bush Administration may have done that ‘deliberately allowed 9/11 to happen, perhaps as a pretext for war’” and is signed by 99 of the most rabid, radical liberals around.  If anything shows this guy is a virulent leftist radical this does.  Now Van Jones is taking the Clinton/Obama line by claiming that “the petition that was circulated today, I do not agree with this statement and it certainly does not reflect my views now or ever.”  But yet “Mike Berger, a spokesman for 911Truth.org, told the Washington Times over the phone that all of the signers had been verified by their group.  He said 9/11Truth.org board members ‘spoke with each person on the list by phone or through email to individually confirm they had added their name to that list.’”  So who’s lying here??

Once again the mainstream media is doing a great impression of 3rd world, banana republic state run media.  With friends like this why takeover the media and make it state run?  Imagine if this was someone that the Republicans had placed close to the President.  Rather than yawning and ignoring it, the media would come out frothing at the mouth screaming about it.  Nothing like good old liberal hypocrisy.

For those of you who want the Federal Government to take over the healthcare industry (approximately 1/5 of the American economy), let's do the math.

For those of you who want the Federal Government to take over the healthcare industry (approximately 1/5 of the American economy), let’s do the math.

1. Social Security: Insolvent due to being a heavily used slush fund for politicians’ out of control spending habits (SS can only invest surplus funds, the difference between incoming tax revenue and outgoing benefits, in government securities)

2. Amtrak: Insolvent despite constant government bailouts

3. Post Office: Insolvent (will be passing out IOUs instead of paychecks by Oct. 2009)

4. Medicare: Insolvent w/ massive fraud problems

5. Medicaid: Insolvent w/ massive fraud problems

Tell me again why this is a good idea.  Remember, the definition of insanity is doing the same thing over and over again expecting a different result.  I think healthcare reform as it has been presented absolutely fits the definition of insanity.  Still don’t believe me?  Give me one good example of a government program that is run efficiently and cost effectively.  I’ll wait….

Moveon.org supporter bites off finger of man opposed to Obamacare - Tell me again who the nutcases are?

An altercation begins between William Rice, right, in khaki shirt and olive shorts, and an unidentified man wearing black, who authorities say bit off Rice’s little finger. Anyone with information about the biting incident is asked to call Crime Stoppers at 800-222-TIPS.

An altercation begins between William Rice, right, in khaki shirt and olive shorts, and an unidentified man wearing black, who authorities say bit off Rice’s little finger. Anyone with information about the biting incident is asked to call Crime Stoppers at 800-222-TIPS.

An opponent of government healthcare programs had part of a finger bit off during a fight at a pro-healthcare-reform rally this week in Thousand Oaks.

William Rice, 65, of Newbury Park was with a small group of counter-protesters at a vigil Wednesday night organized by Moveon.org when a man bit off part of his left pinky finger during a scuffle, authorities said. Doctors were unable to reattach Rice’s finger.

Sheriff’s detectives Thursday were still looking for the man who bit Rice. Investigators also were sifting through conflicting accounts of the incident, but Rice acknowledged that he threw the first punch.

“When he got in my personal space, I popped him in the nose,” Rice said in a phone interview Thursday. “I felt like I had no choice other than to defend myself.”

The incident was reported at 7:26 p.m. Wednesday at Lynn Road and Hillcrest Drive, where more than 100 people gathered for the pro-healthcare-reform vigil.

About 15 people opposed to President Obama’s healthcare reform stood across the street from Moveon.org’s group. Members of Code Pink: Women for Peace also were there, authorities said.

Rice got involved in a heated discussion with a member of Code Pink, said sheriff’s Capt. Ross Bonfiglio, a department spokesman. After the argument, Rice returned to where his group was standing. An unidentified man then walked from Moveon.org’s area toward the opponents and verbally confronted Rice, allegedly calling him names and acting aggressively, Bonfiglio said.

Rice told investigators he felt threatened by the man and punched him in the nose, Bonfiglio said. A fight ensued, during which part of Rice’s finger was bitten off, Bonfiglio said.

Rice drove himself to Los Robles Hospital & Medical Center in Thousand Oaks. Another man found the bitten-off portion of the finger and took it to Rice at the hospital, Bonfiglio said.

Doctors told Rice the pinky, severed near the second knuckle, could not be reattached because of high bacteria levels from a human bite, he told the Ventura County Star.

Rice said he did not initially plan to participate in any demonstration Wednesday. He was driving by when he spotted Code Pink members, and he stopped to see if they were protesting the military, he said. Rice has a son who is an officer in the Marine Corps.

After a brief exchange with Code Pink members, Rice said, he was satisfied they were not protesting the military. He was leaving when a man who seemed “deranged” approached and called him an “idiot,” he said.

Rice said he felt like the man had singled him out because he was the “easiest target.” But the incident happened quickly, he said, and he doesn’t clearly remember everything that preceded the altercation.

Scott Bush, 43, of Thousand Oaks said he was standing with Rice in the group opposed to healthcare reform when the man walked over from the Moveon.org group. Bush said the man asked the group if it supported a public health insurer option, and members responded “no.” The man then singled out Rice and asked him why, according to Bush. When Rice responded that he didn’t want the government involved in anything, the man moved toward Rice and yelled, “You’re an idiot,” Bush said.

Bush said Rice then hit the man in a defensive move. The man then pulled Rice into the street, according to Bush.

After a fight that lasted only a few seconds, Bush said, he heard Rice say, “He bit my finger off,” and he saw a stump.

Several witnesses said Rice’s shirt was ripped during the scuffle.

Bush said he later found the roughly 1-inch piece of finger about 20 feet away and took it to Los Robles Hospital.

The suspect left before police arrived, authorities said. He was described as a short man with a medium build, wearing a blue cap, black shirt and black shorts.

Detectives were still trying to determine much about the incident, including whether the man intended to bite off Rice’s finger, sheriff’s Detective Eric Buschow said.

Rice said he thinks the man intended to harm him but not bite off his finger.

Authorities did not consider the man a criminal suspect Thursday and were not looking to arrest him, Buschow said. “We want him to come forward so we can talk to him. We want to hear his side,” Buschow said. “He’s part of the puzzle.”

The man did give an account of the incident to people at the Moveon.org gathering before he disappeared, said Joanie McClellan of Thousand Oaks, an organizer of the vigil. The man was visibly shaken, with his glasses askew and a lens missing, she said.

McClellan said no one at the gathering knew the man, who never gave his name and said he wasn’t on the Moveon.org list. McClellan, also involved with Code Pink in Ventura County, said she did not see the altercation.

The man told McClellan he was on his way to the healthcare vigil when Rice heckled and then hit him, she said. The man acknowledged he had bitten Rice’s finger, she said.

“We had asked him to go and sit on the grass so he could calm down, and I never saw him again,” she said.

Although he did not plan to protest Wednesday, Rice said, he’s opposed to government involvement in general, except for mail service and the military.

“It doesn’t have any business in anybody’s healthcare,” he said.

Rice acknowledged he used the Medicare he gets as a senior when he went to the hospital Wednesday. He said it was the first time he used the program, to which he remains adamantly opposed.

“If I had any other options, I would not have used it, even though I pay for it,” he said.

Emily Kryer, spokeswoman for U.S. Rep. Lois Capps, said the incident will not affect plans for a healthcare forum Friday night in Oxnard. The congresswoman will co-host a community information session at 6 p.m. at Bethel AME Church. Kryder said Oxnard police officers will provide security.

Anyone with information about the biting incident is asked to call Crime Stoppers at 800-222-TIPS.

So the finger biting victim FIRST punched the biter in the nose and then got his finger bitten off in retaliation.

assault is defined as the THREAT or attempt to strike another, whether successful or not.

"Rice later told investigators he punched him in the nose. The punch set off a fist fight between the two men, during which the tip of Rice’s left pinky finger was bitten off."

Sounds like Rice started the fight and got his finger bit off for his actions.

Kinda serves him right for resorting to violence!

It is ironic that the 65 year old man probably has Medicare and was treated by "socialized medicine" LOL!

Words are not threat Blaine. Throwing the first PHYSICAL PUNCH is the assault. No wonder you never could make it in law!!

He threw the 1st punch, ok but does that deserve to have a finger BITTEN off??? OMG! The force it would take to bite through a bone! That is just complete rage and sickening.

He walked away and was confronted by the moveon.org person, HE WALKED AWAY before feeling threatened enough to throw punch.

A 65 year old man had his finger bitten off, that just floors me...and I am almost equally as outraged that it doesn't outrage others.

Blaine's right. From reading the article, the Tyson impersonator wasn't even involved in the original argument, but went out of his way to confront Rice. Rice felt threatened and punched him.

I've been in situations where people start waving there fingers in front of my face and I simply tell them if they don't stop, I'm going to break it off. Their behavior is a sign of physical aggression and I won't tolerate it.

bobjohnson Well we now know you are a mental giant.

If someone gets in your face and is spitting their STD infected mouth all over you that is considered a deadly weapon and the victim can use whatever force needed to defend themselves.

Cops don't even let a suspect get within 15 feet before a gun or tazer is used.

This is what I mean by learning to read and not be a Jim Jones follower. Would you drink Obama’s Kool-Aid?

<Words are not threat Blaine. Throwing the first PHYSICAL PUNCH is the assault>

JW,
the punch is a battery.
One can use a battery as a defense against an assault. An assault does not need contact - an assault can occur from across a room so long as there is a reasonable apprehension of an imminent battery.

I will be happy to keep providing guidance to you.

Keep insulting, it only makes you look more childish.

Really!!!

<people start waving there fingers in front of my face>
Ojai,
Keep in mind if you are Tyson and 90lb Minnie Mouse waves her finger or threatens, you are not in "reasonable apprehension" (assuming no other factors). But if "reasonable apprehension" of a battery exists, then you can break them. Always remember its best not to have to explain...

Posted by bobjohnson on September 3, 2009 at 10:33 a.m. (Suggest removal)

"an assault can occur from across a room so long as there is a reasonable apprehension of an imminent battery."

Nowhere!!

Posted by joocanu on September 3, 2009 at 10:33 a.m. (Suggest removal)

What Exactly Does "Making a Terrorist Threat" Mean?
The crime of "making a terrorist threat" is a recent creation enacted at both the state and federal levels after the terrorist attacks of 9/11. It is a very general law that can be used to prosecute terrorists, but has been used far more often to prosecute situations involving domestic violence, hate crimes, bomb threats, and school violence. Indeed, in many states, the term "terrorist" has been amended to mean simply "criminal."

Someone willfully threatens to commit a crime that will result in death or great bodily harm. This means that the threat obviously has to be of a highly dangerous nature. Threatening to slash someones tires, for instance, would probably not be sufficient. However, the threat can be made in any medium, written, orally, or electronically transmitted.

The actions of these two men do not represent anyone except themselves and their own poor choices and inability to control their anger. The nose puncher is not a typical conservative republican, and the finger biter is not a typical liberal democrat. Their actions do not define either side of this issue and only serve to polarize everyone else. Ridiculous. It sounds like they were both completely out of line.

I would like to point out that calling the healthcare issue Obamacare is ridiculous. Obama has not written any of the proposed initiatives. The current system of health insurance and insanely and increasing expensive healthcare in this country is driving people into bankruptcy while it amasses billions of dollars in profit at the expense of our citizens' health and pockets. It has to be changed! If you don't see that it is broken, you are either blind, ignorant or don't want to accept facts. How it gets changed should be a topic that we ALL open our minds to and have collaborative, creative and civil discourse about. There are probably many good solutions but as long as either side is staunchly rooted in an unmovable position and uses tactics of disruption rather than discourse, nothing good is likely to come of any meetings.

What a bunch of maroons.

The government has promised more benefits than it can provide and has frittered away the money it was supposed to have for future obligations. Obamacare is simply a cash grab by the government to steal the premiums being paid by the most productive members of society and redistribute them to the "unfunded liabilities".

JW asked <where did it say the 65 year old had been threatend>

right here JW:
"Rice later told investigators he felt threatened by the man" paragraph 6, 1st sentence

JW also states <"spitting their STD infected mouth all over you that is considered a deadly weapon and the victim can use whatever force needed to defend themselves." Not under the California Penal Code>

JW is correct. It is not in the penal Code.
It is in California Health and Safety Code, Chapter 4 § 120290
...any person afflicted with any contagious, infectious, or communicable disease who willfully exposes himself or herself to another person, and any person who willfully exposes another person afflicted with the disease to someone else, is guilty of a misdemeanor.

JW is also correct that california Penal Code does not state you can use force in protectinbg against infection.
That would be a "Defense". defenses are not listed in the code. defenses are common law, judicially creayted via case law.

Thanks for the help here JW

The government hasn't promised anything! There are a myriad of proposed plans to bring affordable health coverage to ALL citizens, none of which have been selected as yet. The doom and gloom predictions of what will happen if the government steps in with controls on the currently broken system are premature and not based on any real facts or figures. Open your minds and realize the current system is costing everyone more. Those with no coverage are being treated at the highest possible cost in ER's as well has having surgeries and other treatments that they don't pay for because they can't. Who do you suppose ends up picking up the tab for that?? Right, those of us with insurance in the form of higher priced care and higher premiums!

Blaine: Who is this JW person you keep imagining???

"Feeling" threatened is not the same as "being" threatened. But it does help one make an excuse for throwing the first punch. Nowhere in the article does it say that any witnesses stated a verbal threat was made.

And where does it state the biter actually had a case of STD? Or was even spitting? Nowhere.

Tanker: I see you chose to ignore my point, which is that both sides need to ratchet down the vitriol, name calling and rhetoric. Your comment only serves to further polarize your detractors. Open your minds to the idea that the "other" side might have some good points. And I say that to both sides. It can't continue to be an "us against them" situation. Nothing will change. The status quo is not working and change must happen. If you wish to be part of constructive change, then act responsibly and speak constructively and stop the branding and name calling.

Looks to me like Rice started an argument (verbal assault) with a bunch of women, then got bent out of shape when a man returned the favor. He couldn't handle it so he punched the guy and got his finger bitten off as a result.
_______________________________

I think you're correct Mr_E_Man. If it's the same guy as I think it is, he was confronting people about the war on the pro-reform side and was extremely angry and belligerent. Again, I don't think he was even part of the opposing side. He was just picking fights with whoever.

MoveOn has a well earned reputation of outrageous behaviors in both speech and actions. The MoveOn guy pushed the button of the wrong guy. The MoveOn guy instigated the incident by crossing the street and was probably in Rice's face. The Star doesn't state so, only the witnesses know for sure, but I'll bet that's what happened.

1st) What is that supposed to mean.....? Are you saying you would shoot him?? or are you saying you would brandish the gun to scare him? Either one is a crime and a very serious one at that.

2nd) Being a member of the NRA doesn’t get you a CCW permit.....They are very hard to get in this county and I doubt you have one legally, by the way you talk.

I'm sorry you feel that you need to insult me and doge my question. I am just trying to figure out why you mentioned your gun and your NRA membership.

Posted by megnosis on September 3, 2009 at 12:50 p.m. (Suggest removal)

Do people just gloss over the article? It's odd that information's only been gathered from the pro-insurance side. And that information seems doubtable. For instance-

---
'Bush said Rice then hit the man in a defensive move. The man then pulled Rice into the street, according to Bush.'
---

But then we get the report later down-

---
'He was described as a short man with a medium build...'
---

So the report indicates this was a relatively small man, while other reports on the internet indicate that Rice, even at 65, is rather tall, or large for our purposes.

Bush also claims Rice was pulled into the street, which means the man was put into the street by Rice's punch, into traffic. And this smaller man was the threat?

Not sure I can believe the pro-insurance folks on this one. And it seems odd that there's no report on Rice's belligerant attitude towards women earlier.

Finally, from a world experience standpoint, the weaker person in a phyiscal conflict has to resort to a biting attack. It's clear that until the biter bit, he was the victim in that scenario.

There is no excuse for either behavior, and I don't think anyone should be standing at the side of either man.

Posted by kengreen on September 3, 2009 at 12:56 p.m. (Suggest removal)

If I yell "You're an idiot" at you, and you punch me in return. I can guarantee that no judge will say that you acted in self defense. But, the story is pretty funny. I only wish we knew what sort of health insurance the fingerless man had. I mean, I hope the government didn't pay for his finger to get reattached in the emergency room. If so, he should be billed the $15,000 the surgery cost.

Well, OhBummer DID tell his thugs to "get in the face" of his opponents, and so his mind-numbed robots in Code Pink and Move On did exactly that to a 65 year-old man who opposes the healthcare hijackers. It's not healthcare "reform," by the way, it's just another falsification of reality from the OhBummer Wrecking Crew.

So the old man refrains from slugging the Code Pink shrew who "got in his face" for opposing OhBummer, and then a thug from Move On moved in on him and invaded his personal space in a threatening way and insulted him. The only thing wrong with the old man's response is that he let the Move On thug get away, as clearly, we don't need such thugs out on the street threatening OhBummer's critics with bodily harm. Watch out for a black-shirted Move On thug and turn him over for a beating by the police with a rubber hose. ~:<)

If somebody crossed a street and got in my face I would punch them too. That is no excuse for biting someone's finger off! BTW, lawabider, you are obviously not too smart. Do you really think you can just sew someone's finger back on???? There is a lot more involved in reattaching a body part then simply "sewing it back on"; it is not a simple procedure.

Let's not forget that this is only one of many extreme acts of violence employed by the Obamacare supporters.

So-called "Peace Activist" Grant Markus attacked a Doctor outside the last Thousand Oaks Democrat Health Forum. As a Doctor tried to voice his real life experience and concerns regarding the various health care proposals Markus lunged at him to silence him. Guess he is lucky Markus had a full stomach and the good Dr. didn't lose any body parts to the "moral imperative" of their cause. The Ventura County Deputies had to lead this wacko away away in handcuffs. Or maybe he returned to the scene hungry for more confrontation? After all the Mike Tyson finger chomper is still on the loose right?

The real incident happened like this. A group of 100 pro healthcare types were
on one side of the street and about 25 counter protesters were on the other side
of the street . One person from the group of 100 strode across the street and
aggressively confronted the smallest and oldest member of the counter-protesters
and picked a fight physically dragging the 65 year old counter-protester into
the street. The fight ensued and then the 65 year old man came out of the
scuffle with his hand bleeding. The bully ran back to the Pro Health care group.
I heard this from an eyewitness on the news that found the finger and took it to
the hospital so they could reattach it.
